BUS TRANSIT LIMITED WARRANTY WARRANTY. Subject to the conditions and limitations set forth below Ergo Transit (the Manufacturer) warrants it’s seating product was manufactured and delivered free from substantial defects in material and workmanship and will remain in such condition for the term described below. This warranty extends only to the original OEM installer, Commercial / Transit operator that purchased the product and is non-transferable.
THIS WARRANTY DOES NOT APPLY, OR INCLUDE COVERAGE FOR, DEFECTS ATTRIBUTABLE TO:
a) NEGLIGENCE OR MISUSE;
b) FAILURE TO COMPLY WITH INSTRUCTIONS FOR SERVICE OR MAINTENANCE;
c) ACCIDENT, UNAUTHORIZED REPAIRS OR MODIFICATIONS OR UNAUTHORIZED USE;
d) DAMAGE OR PRODUCT FAILURE CAUSED BY FREEZING, FLOODING, FIRE OR ANYOCCURRENCE THAT MIGHT BE TERMED AN ACT OF GOD;
e) ITEMS ORDINARILY DEPRECIATED BY USE, IE; WEAR AND TEAR;
f)NORMAL MAINTENANCE ITEMS;
g) EXPOSURE TO THE ELEMENTS, EXCESSIVE HUMIDITY, FADING OR DISCOLORATIONOVERTIME, FAILURE TO FOLLOW INSTRUCTIONS FOR SAID, CLEANING,MAINTENANCE, CORROSIVE MATERIALS, IMPROPER LOADS, EXCESSIVE HEAT ORBURNS, AND NON- RECARO SUPPLIED PARTS OR BRACKETS;
h) ANY CONDITION OR DAMAGE FROM REMOVAL OR REISTALLATION OF PRODUCT INTHE SAME OR OTHER APPLICATION;
i) CONDITION CAUSED BY NORMAL WEAR AND TEAR OF PRODUCT;
TERM.
The provisions of this Warranty commence from the day the product is produced defined by the serial # / manufacturing date located on the seat, continue:
a) (2) Two-years from the date as defined above or 100,000 miles on the entire product with theexclusion of, the fabric and foam, which is warranted for one (1) year;
b) (2) Two-year from the date as defined above or 100,000 miles for coverage of warranty repairlabor charges;
EXCLUSIVE REMEDY.
During the Warranty Period, the Manufacturer will as the exclusive remedy under this Warranty, repair or replace any part or parts of the Ergo Transit seating product which conforms to the above Warranty, PROVIDED THAT:
(1)A Warranty claim is promptly and properly filed with the Manufacturer and in accordance tothe provided instructions. Claim must be submitted within 30 days from the date the repair isperformed.
(2)All parts used in conjunction with a warranty repair are returned to the manufacturer in aproperly labeled package that will identify them as warranty return part(s) per instructionsprovided.
LIMITATIONS.
This Warranty is limited exclusively to the originally purchased Ergo Transit seating product. The Manufacturer reserves the right to make changes or improvements at any time in the design of or upon the Ergo Transit Seat without any obligation to make a corresponding change or improvement in or upon the Ergo Transit Seat previously manufactured by it.
THIS IS THE EXCLUSIVE AND COMPLETE WARRANTY MADE BY THE MANUFACTURER WITH RESPECT TO THE ERGO TRANSIT SEAT. NO PERSON WHATSOEVER IS AUTHORIZED TO MAKE ANY REPRESENTATION, WARRANTY OR PROMISE ON BEHALF OF THE MANUFACTURER. THE MANUFACTURER MAKES NO OTHER EXPRESS WARRANTIES AND DISCLAIMS ANY AND ALL IMPLIED WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE REMEDIES SET FORTH ABOVE PERTAINING TO REPAIR OR REPLACEMENT OF PARTS OR MATERIALS ARE EXCLUSIVE OF ALL OTHER REMIDIES THE DEALER / OEM MAKES NO WARRANTY ON HIS OR HER OWN OR ANY ITEM WARRENTED BY ERGO TRANSIT, AND MAKES NO WARRANTY AGAINST DEFECTIVE INSTALLATION UNLESS THEY DELIVER TO PURCHASER A SEPARATE WRITTEN WARRANTY CERTIFICATE SPECIFICALLY WARRANTING THE ITEM. THE INSTALLER HAS NO AUTHORITY TO MAKE REPRESENTATION OR PROMISE ON BEHALF OF ERGO TRANSIT, OR TO MODIFY THE ITEMS OR LIMITATIONS OF THIS WARRANTY IN ANY WAY. NEITHER THE MANUFACTURER NOR IT’S DEALERS UNDER ANY CIRCUMSTANCES ASSUME ANY RESPONSIBILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SUCH AS, BUT NOT LIMITED TO, EXPENSES FOR TRAVEL, LODGING, LOSS OR DAMAGE TO PERSONAL PROPERTY, LOSS OF REVENUE, LOSS OF TIME, INCONVENIENCE, OR TOWING.

In order to obtain warranty service you must comply with the following conditions: (1) Call Ergo Transit’s Customer Service at 1(800) 873-2276 and request a warranty claim form. (2) Completely fill out the warranty form and mail it back to the attention of: Warranty Administration at Ergo Transit @ 24801 Capital Blvd | Clinton Twp | MI 48036 | USA. (3) Defective parts must be shipped to Ergo Transit @ 24801 Capital Blvd | Clinton Twp | MI 48036 | USA, for Technical evaluation. If defective parts are not shipped within 30 days of receiving the Return Authorization Number and packaging slip credit will not be issued for the replacement parts.
